Terms and Conditions Of Access

This agreement is between you and the Mann Publishing Group.  By accessing the Mann Publishing Group website and/or any content, information, materials or features thereof you understand and agree to ALL of the following terms and conditions:

OWNERSHIP: All right, title, and interest in the equipment, software, content, information, materials and facilities used by Mann Publishing Group or its corporate affiliates to provide this website will remain vested in Mann Publishing Group, its corporate affiliates or its suppliers.  Nothing contained herein shall be construed by implication, estoppel or otherwise as granting to a license under any copyright, trademark, patent or other intellectual property right of Mann Publishing Group, its corporate affiliates, suppliers or any third party.

TRADEMARKS:  The Mann Publishing Group name and logo and all related product and service names, design marks and slogans are trademarks, service marks or registered trademarks of Mann Publishing Group or its parent and corporate affiliates and may not be used in any manner without the prior written consent of Mann Publishing Group. CONSENT TO MONITORING AND DISCLOSURE: Mann Publishing Group is under no obligation to monitor the content, information or materials residing on or transmitted to this website. However, anyone accessing this site agrees that Mann Publishing Group may monitor the website to (1) comply with any necessary laws, regulations or governmental requests; and (2) in its sole discretion, to operate the Mann Publishing Group website in a manner it deems proper or to protect against conduct it deems inappropriate. All claims must include the following information:

1.	A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; 
2.	Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works at a single on-line site are covered by a single notification, a representative list of such works at that site; 
3.	Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material; 
4.	Information reasonably sufficient to permit the service provider to contact the Complaining Party, such as an address, telephone number, and if available, an electronic mail address at which the complaining party may be contacted; 
5.	A statement that the Complaining Party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and 
6.	A statement that the information in the notification is accurate, and under penalty of perjury, that the Complaining Party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

FORCE MAJEURE: Mann Publishing Group will not be liable for delays, damages or failures in performance due to causes beyond its reasonable control, including, but not limited to, acts of a governmental body, acts of God, acts of third parties, fires, floods, strikes or other labor-related disputes, of other things Mann Publishing Group does not control, or an inability to obtain necessary equipment or services.

CHOICE OF FORUM AND LAW: You and Mann Publishing Group agree that the substantive laws of the State of New York, without reference to its principles of conflicts of laws, will be applied to govern, construe and enforce all of the rights and duties of the parties arising from or relating in any way to the subject matter of this agreement. YOU AND Mann Publishing Group CONSENT TO THE EXCLUSIVE, PERSONAL JURISDICTION OF AND VENUE IN A COURT LOCATED IN NEW YORK, NEW YORK FOR ANY SUITS OR CAUSES OF ACTION CONNECTED IN ANY WAY, DIRECTLY OR INDIRECTLY, TO THE SUBJECT MATTER OF THIS AGREEMENT. Except as otherwise required by law, any cause of action or claim you may have with respect to your access to and use of the content, information and materials on the Mann Publishing Group website must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred.
